Sworn translation of a power of attorney or notarial deed

You live abroad and need to sell a property in Italy, accept an inheritance or sign before a notary without travelling: the answer is a power of attorney. If you signed it before a foreign notary, the Italian notary wants it apostilled and translated. We translate powers of attorney and notarial deeds, with certification and land registry data.

    What this translation is for

    Sworn translation of a power of attorney or notarial deed: what to know before ordering

    Powers of attorney signed abroad, for use in Italy

    The most common case is a special power of attorney signed before a foreign notary so that someone can represent you in Italy:

    • sale or purchase of a property: your attorney signs the deed of sale for you;
    • inheritance: acceptance or renunciation of an estate, division between heirs, the inheritance declaration;
    • banks: transactions on an account or closing a relative's account;
    • companies: attending shareholder meetings, appointing directors, transferring shares.

    Before it can be used, the power of attorney must be apostilled (or legalised) in the country where it was signed and translated into Italian. The Italian notary usually files it with the deed together with the translation. Ask the notary what form of translation they want: some ask for it to be sworn before an Italian court (asseverazione), which we arrange on quote.

    Company deeds and documents

    We also translate foreign deeds of incorporation, statutes, minutes of meetings and commercial register certificates (Kbis, Handelsregisterauszug, certificate of incorporation, certificado del registro mercantil), requested by notaries, banks and chambers of commerce to open an office or branch in Italy or to deal with a foreign company. The other way round, we translate Italian company register extracts (visure) and statutes for a foreign body. Details on the page sworn translation of company documents.

    Atto notorio, declarations and inheritance

    We also translate the atto notorio and its foreign equivalents, such as the French acte de notoriété or the German certificate of inheritance, official declarations and inheritance documents required by the notary, the bank or the Agenzia delle Entrate. Details on the page sworn translation of the atto notorio.

    What the translator renders

    • the appearance of the parties and their details;
    • the list of powers granted, word for word, because the notary checks they cover exactly the deed to be signed;
    • the property's land registry data (foglio, particella, subalterno) and addresses, reproduced unchanged;
    • the foreign notary's certification wording, stamps, seals and the apostille.

    Price and timing

    25 € per page; a special power of attorney usually runs to two to five pages, apostille included. You receive the signed and stamped PDF within 24-48 working hours, ready to forward to the notary; if they want it on paper, add the copy by post.

    Common mistakes with a power of attorney signed abroad

    • Signing abroad a power of attorney drafted without first checking with the Italian notary: the powers may not cover the deed to be signed.
    • Using a general power of attorney when the notary wants a special one for that sale.
    • Having the power of attorney translated before the apostille.
    • Land registry data or the property address differing from those in the deed of sale.

    FAQ

    Questions about this translation

    Does an Italian notary accept a power of attorney signed abroad?
    Yes, if it is apostilled or legalised in the country where it was signed and translated into Italian. The notary decides the form of the translation: some accept a sworn translation, others ask for an asseverazione in Italy, which we arrange on quote.
    Is the property's land registry data translated?
    It is reproduced exactly as in the original: foglio, particella, subalterno and address are not changed, because the notary checks them against the land registry and the deed to be signed.
    Do you also translate statutes and register extracts of foreign companies?
    Yes: deeds of incorporation, statutes, minutes and commercial register certificates, from other languages into Italian and the other way round. The price is the same per page; we confirm the total before starting.
    Can the Italian notary draft the power of attorney?
    Often yes: many notaries send a draft, sometimes bilingual, to sign abroad before a local notary. Starting from their text reduces the risk that the powers fall short.
    Is a general power of attorney enough to sell a property?
    It depends on the wording and on the deed. Many notaries prefer a special power of attorney naming the property and the terms of sale: ask the notary before signing.
